Terms and Conditions
These Terms and Conditions are in place to be adhered to by property owners (a "Property Owner") placing advertisements on www.letsgetlocal.co.uk ("our site") or by a person using our site to search for accommodation or make use of the site for another reason (a "Guest"). By accessing or using our site you agree to be bound by these terms and conditions ("Terms and Conditions") in relation to both Property Owners’ and Guests’ use of our site.
Our site is operated by Lets Get Local Limited ("we", "us", "our"). We are registered in Scotland under company number SC463797 and have our registered office at 2 Murrayfield Drive, Edinburgh, EH12 6EE.
Our business operates as an advertising service for Property Owners and an accommodation search facility for Guests. We do not own, inspect or provide content for any of the properties advertised on our site, and therefore make no claims as to the quality, safety or legality of any of the properties listed.
The Property Owner shall be responsible for ensuring that it has all necessary rights, licences and authorisations to rent property. Properties must be covered by up to date and valid Fire Risk Assessments, PAT Tests, EICR Certificates, Gas Safety Certificates, Legionella Risk Assessment
The Property Owner must hold relevant Public Liability and Holiday Let Insurance
We do, on occasion, provide a photography service to Property Owners. Although we may provide the photograph or video, we do not warrant that we have conducted any inspection of the property
We provide Welcome Packs for Property Owners and Guests, which remain in the property, and are based entirely on the information provided to us by the Property Owner. It is the sole responsibility of the Property Owner to ensure that the information provided to us is accurate.
Lets Get Local provides an online payment platform for property bookings. The system allows Guests to use PayPal, credit card, debit card or other payment options.
Guests are required to make a deposit of 20% of the total booking amount, at the time of booking. This deposit is non refundable in the event of cancellation.
The balance of the booking amount is payable one month in advance of the first day of property occupancy. The balance is payable to Lets Get Local Ltd. It is the sole responsibility of the Guest to pay for the rental by the deadlines stipulated on the booking confirmation.
All monies are retained by Lets Get Local until successful completion of the stay, after which the Property Owner will receive all monies net of Lets Get Local’s agreed fees and commission.
Whilst we may provide the technical platform to enable payments, we are not responsible for the payment solutions themselves and must state that we are not a party to the contract between the Guest and the Property Owner. Should PayPal or any other provider decline the Guest’s payment, we are not responsible for this decision, and we shall not be held liable for any losses suffered as a result of making an online payment to a Property Owner.
The Guest must agree to indemnify and keep us indemnified from and against any and all claims, actions, proceedings, damages, losses, liabilities and expenses (including legal fees) suffered or incurred by us arising out of or in connection with their use of our online payment platform to make payments to Property Owners, in particular any claims from Property Owners, PayPal or other payment solution providers resulting from the Guest’s actions or omissions.
Property Owner Fees
The Property Owner will be charged 15% + VAT on all confirmed bookings.
Any additional channel marketing fees (for properties being advertised on other sites such as Booking.com, Homeaway, Airbnb, Holiday Lettings etc) will be deducted from the property income at source.
A set booking fee will be charged, per booking, to pay for personal meet and greet at check in, cleaning, laundry, provision of linen and towels, toiletries, tea, coffee, sugar, milk. This cost varies depending on the size of property and will be set once housekeeping has visited for the initial clean.
Should the Guest wish to cancel the booking with us this must be advised in writing by the Guest who has made the booking. The Guest will be liable to cancellation charges, as detailed below, and these will be calculated from date at which we received notice.
More than one month’s notice: Loss of deposit
Less than one month’s notice: 100% of booking price
Please note that notice of cancellation will only be deemed to have been effectively given upon us issuing acknowledgement of receipt to the Guest and, where necessary, it is the Guest’s responsibility to follow up by phone or other means to ensure that we have received the notice of cancellation. The Guests are responsible for arranging appropriate travel insurance to cover the risk of having to cancel the booking and, for the avoidance of doubt, no such insurance is provided as part of the booking.
In instances where a booking has been made through one of Lets Get Local's 3rd party marketing channels, this cancellation policy will revert to the cancellation policy set out in the 3rd party's Terms and Conditions.
Property Owner Cancellations
A booking will be considered as confirmed at the time of booking and any cancellations by the property manager will be subject to the agreed rate of commission
The Property Owner must honour all confirmed bookings.
In the unlikely event that the Property Owner cannot provide The Property to rent for The Guests for a confirmed booking, the owner will be responsible for finding alternative accommodation of the same or superior quality for The Guest and agrees to pay any difference between the sourced alternative accommodation and the price of their own confirmed booking.
If The Property Owner cancels a confirmed booking, with the consent of The Guest or The Guest decides to find their own alternative accommodation, The Owner will be liable for refunding to The Guest any difference between the gross rental paid by The Guest and the commission taken by Lets Get Local
Once a booking is confirmed, Lets Get Local’s commission cannot be refunded to The Property Owner or The Guest.
Liability and responsibility
Property Owners are solely responsible for advertising their properties accurately and with truthful photography. All liability and responsibility therefore rests with the Property Owner, should there be any loss or damage (including personal injury) as a result of misinformation or omission provided with the property details on our site.
Any contract for the rental of any property listed on our site is directly between a Property Owner and a Guest and we are not a party to that contract. Both the Property Owners and Guests are each responsible for complying with the terms of the booking contract between the Guest and Property Owner.
Lets Get Local holds no liability or responsibility for any incident or occurrence which takes place at a property.
Only the Guest who has made the booking, along with named Guests are permitted to occupy the property. The number of Guests occupying the property will not exceed the party size agreed at the time of booking, unless prior permission is sought from the Property Owner. The Guests have no right to occupy the property outside of the period of booking, or to sublet the property.
Guests are responsible for keeping the property and its contents in the same condition during the stay as at the start date of the Booking. The property must be left in a clean and tidy condition at the end of the Booking. In the event of the Guest breaching their obligations in this respect, the Guest must agree to reimburse the Owner upon demand for the cost of making good any damage, breakage, cleaning or loss.
Guests are responsible for ensuring that they and any member of their group do not cause a nuisance or disturbance to other residents, neighbours or occupiers. Should there be any complaint of disturbance, the Property Owner will investigate and may have the right to demand early termination of the booking agreement.
The Property Owner is not responsible for any loss, injury of damage to any Guest or any of the Guests’ personal property which arose in any manner out of the let of the property.
Any complaints with regards to the property standards or service will be dealt with by the Property Owner
Our internet service and links from our site
There may at times be interruptions of service and delays with the use of our website, due to the very nature of the Internet. We will take care to maintain continuity of our site, but do not accept any ongoing obligation to operate our site.
Our site does contain links to other sites, in the local guides. We are not responsible for the content on these other sites, but provide them purely for your information.
Changes to Terms and Conditions.
Lets Get Local may amend these Terms and Conditions at any time and at its sole discretion. Any amends made will be uploaded to the site immediately.
